1. Parties to the Agreement

This Agreement is entered into between

e-mail: info@bmsbaltic.com 

(hereinafter – Seller), and a private natural or legal person (hereinafter referred to as Buyer) who makes a purchase on the Seller's website “Z1 Distributions” (hereinafter referred to as – e-shop).

2. Subject of the Agreement

2.1. This Distance Contract governs the legal relationship between the Buyer and the Seller regarding the purchase of goods in the Seller’s online store.

2.2. The Agreement applies to all orders placed in the online store.

3. Conclusion of the Agreement

3.1. The Agreement enters into force at the moment the Buyer places an order in the online store and receives the Seller’s order confirmation electronically.

3.2. An order and its confirmation shall be deemed received when the Buyer has access to them.

4. Prices and Product Information

4.1. All prices in the online store are indicated in euros (EUR) and include value added tax (VAT), where applicable.

4.2. The Seller reserves the right to change product prices at any time. The Buyer shall be charged the price valid at the time of placing the order.

4.3. In the event of an incorrect price published in the online store due to technical reasons, the Seller has the right to cancel the order and inform the Buyer accordingly.

4.4. Product descriptions and images are for informational purposes only. Images may differ from the actual appearance of the product.

5. Ordering Procedure

5.1. The Buyer may place orders with or without registration.

5.2. To place an order, the Buyer must select products, specify quantities, complete the order form, and make payment.

5.3. The invoice is issued electronically and sent to the Buyer’s specified e-mail address. The Buyer agrees to receive the invoice electronically.

6. Payment

6.1. Payments are made via non-cash settlement methods using the payment solutions offered in the online store.

6.2. Deposit services and cash withdrawals are not provided to the Buyer.

7. Delivery

7.1. Delivery of goods is carried out in accordance with the Delivery Terms published on the website www.bmsbaltic.com.

7.2. The risk of loss or damage to the goods transfers to the Buyer at the moment the goods are handed over to the Buyer or to a person designated by the Buyer.

8. Right of Withdrawal (Consumers)

8.1. The Buyer who is a consumer has the right to withdraw from the Agreement within 14 (fourteen) days from the date of receipt of the goods, without providing any reason.

8.2. The right of withdrawal does not apply to legal persons or to goods for which the right of withdrawal is excluded under applicable laws.

8.3. The withdrawal notice must be sent to the e-mail address info@bmsbaltic.com.

9. Refund

9.1. The Seller shall refund all payments received from the Buyer no later than 14 days from the date of receipt of the withdrawal notice.

9.2. The refund shall be made using the same payment method that the Buyer used for the initial transaction.

9.3. The Buyer shall bear the costs of returning the goods.

10. Warranty

10.1. Goods are covered by a warranty in accordance with the manufacturer’s terms and the laws of the Republic of Latvia.

11. Personal Data Processing

11.1. Personal data is processed in accordance with the Privacy Policy available on the website www.bmsbaltic.com.

12. Dispute Resolution

12.1. Disputes shall be resolved through mutual negotiations.

12.2. If disputes cannot be resolved, the Buyer has the right to contact the Consumer Rights Protection Centre (CRPC) or use the EU ODR platform.

13. Final Provisions

13.1. The Agreement shall be governed by the laws of the Republic of Latvia.

13.2. The valid version of the Agreement is published on the website www.bmsbaltic.com.
